1. Acceptance of these General Conditions of Sale

These General Conditions of Sale apply to visitors to the website www.quintadalapa-wines.com (hereinafter Customer) and also to any commercial transactions carried out by them, through the virtual store at www.quintadalapa-wines.com

Browsing the website, as well as purchasing any product in the online store, implies acceptance of these General Conditions of Sale by the Customer.

2. Object

As presentes Condições Gerais de Venda têm por objeto disponibilizar e definir todas as informações necessárias ao Cliente sobre as modalidades de encomenda, venda, pagamento e entrega das compras efetuadas através da loja virtual em www.quintadalapa-wines.com

3. Conditions of Access and Use of the Website

Access to the AGROVIA Online Store is free and does not require prior subscription or registration from the User.

Alcoholic drinks available for sale in the Online Store can only be purchased by individuals who are of legal age in their country of residence (18 years old in Portugal) and who do not have any legal impediment and/or restriction that prevent them from purchasing drinks. alcoholic.

4. Orders

To make purchases through the website www.quintadalapa-wines.com, the Customer must register by creating a personal account and filling out the form provided for this purpose. After registering on the website, the Customer places his order by adding the items he wishes to purchase to the shopping cart. The Customer must follow all steps of the purchase for it to be completed successfully.

Validation of the purchase order implies that the Customer is aware of and accepts, expressly and unequivocally, the prices and description of the products available for sale, as well as these General Conditions of Sale, available for consultation on the website www.quintadalapa-wines .with

All available wine offers are limited to existing stock.

Delivery of the order is subject to full and effective payment of the indicated price, after verification of good collection.

5. Payment Terms and Conditions

Payment for products is made in full at the time of ordering, through one of the following methods:

  • Credit card (Visa, Mastercard);
  • Multibanco reference;
  • MBWAY
  • Bank transfer to AGROVIA's account domiciled at Banco Millennium BCP with IBAN: PT50.0033.0000.4551.4646.5210.5

In the case of payment by credit card, the debit will be made to the Customer's card immediately after confirmation of dispatch of the goods.

 

In case of out of stock of ordered products, AGROVIA proposes to the Customer that they be replaced, subject to acceptance, with an equivalent product.

 

AGROVIA issues the corresponding invoice and sends it, together with the order, to the address indicated by the Customer.

The data contained in the invoice is the sole responsibility of the Customer, and the invoice once issued cannot be reissued with changes.

6. Deliveries

Deliveries are made within an average of 5 working days from the date of confirmation of payment of the order to AGROVIA. Delivery is carried out by AGROVIA or by a company hired by it for this purpose.

The delivery time indicated is as accurate as possible and may vary depending on issues related to supply and transport, weather conditions or for reasons of force majeure.

Failure to meet the delivery deadline cannot give rise to compensation for losses or damages or deductions. However, if 10 days have elapsed, after the average delivery time, the merchandise has not been received, the order may be canceled at the Customer's initiative.

AGROVIA cannot be held responsible if delivery outside the agreed deadlines occurs due to a fact attributable to the Customer, namely if the Customer has communicated inaccurate or erroneous information about the address of the place of delivery of the order.

Shipping costs will be added to the order, as detailed below:

  • For orders worth more than 50.00 Euros, with VAT included, made in a single delivery in mainland Portugal, no shipping costs will be added;
  • For orders worth less than 50.00 Euros, with VAT included, made in a single delivery in mainland Portugal, shipping costs of 6.00 Euros (with VAT included) will be added, which will be included in the total price of the order;
  • In orders with multiple deliveries in mainland Portugal, shipping costs of 6.00 Euros (including VAT) will be added for each delivery, which will be included in the total price of the order.

Upon receipt of the goods, it is the recipient's responsibility to check the condition of the products and make all necessary complaints in case of breakages or shortages, mentioning reservations on the transport note and, within 48 hours following receipt of the goods, by registered letter with acknowledgment of receipt addressed to AGROVIA.

7. Pricing

Prices are fixed in Euros, with fees and taxes included, taking into account the VAT in force at the date of payment of the order.

8. Cancellation and Return

The Customer has 14 calendar days, counting from the date of receipt of the products, to exercise the right to freely terminate the contract, without the need to indicate the reason and without payment of compensation, under the terms legally provided for and indicated below, namely in the Decree-Law No. 24/2014, of February 14th.

The 14-day period starts from the day following the day: (i) on which the Customer or a third party indicated by them, other than the carrier, acquires physical possession of the product(s), or in the case (ii) in which the Customer or a third party indicated by the Customer, other than the carrier, acquires physical possession of the last product when the Customer has ordered several goods in a single order and the goods are delivered separately.

To this end, the Customer will have to inform AGROVIA in writing of their decision and return the products, to the email geral@quintadalapa-wines.com, with instructions for canceling or returning the merchandise responded to and defined by AGROVIA, by same means of communication.

The return must be made in the product's original packaging, for exchange or refund, after sending the communication referred to above.

When returning, the product(s) (including the packaging that accompanies the product(s), labels and back labels) must remain intact, otherwise the return will be void. It is made.

If the Customer exercises the right to terminate the contract, the return costs will be borne by the Customer.

Once the product(s) has been received at AGROVIA's facilities and after validating the condition of the product(s), the Customer will be reimbursed for the payment made, including delivery costs, within a maximum period of 14 days, under the terms legally provided for in Decree-Law No. 24/2014, of February 14, excluding any type of compensation or loss and damage.

The refund will be made using the same payment method used by the Customer in the initial transaction or by bank transfer to the IBAN indicated by the Customer, if the payment method used does not allow it.

9. Risk

The risk of loss or damage to the goods passes to the Customer when he or a third party indicated by him acquires physical possession of the goods.

However, if the Customer entrusts the transport to a person other than the one proposed by AGROVIA, the risk is transferred to the Customer upon delivery of the goods to the carrier.

10. Protection of Minors – Excessive Alcohol Consumption

Excessive alcohol consumption is dangerous to your health.

The sale of alcohol is prohibited to minors under 18 years of age.

11. Privacy Policy

AGROVIA collects personal data, which it processes as the entity responsible for processing.

All personal data collected is submitted voluntarily and objectively by the data holders, and is intended exclusively for use by AGROVIA, meaning your privacy and protection will be guaranteed.

It is AGROVIA's objective to guarantee absolute respect for the confidentiality and privacy of all information collected and processed from its customers in accordance with legal requirements.

The personal data collected will under no circumstances be made available, shared or revealed to third parties, nor used for any purposes other than those described at the time of its introduction, and may only be used for marketing campaigns or newsletters, when expressly accepted by the data holder.

In accordance with applicable legislation, all data subjects may exercise their rights, namely access to personal data concerning them, their rectification, elimination or limitation of their processing, the portability of their data, or to oppose the your treatment. To do so, you must request AGROVIA, using the contact details described above.

Personal data collected and processed by AGROVIA is kept and archived for the periods established in its own registry, for the time strictly necessary, given the purpose that justifies its processing.

12. Cookies Policy

In accordance with Law No. 41/2004, of August 18, as amended by Law No. 46/2012, of August 29, the AGROVIA website may use cookies with the prior and express consent of Customers. . The Online Store uses cookies on the website, as described below.

The cookies collected are used exclusively by AGROVIA, directly or through external entities subcontracted by it.

The use of cookies aims to improve the performance of the website and maximize your experience when browsing the website, namely allowing faster and more efficient navigation, eliminating the need to repeatedly enter the same information.

All browsers allow the respective Customer to accept, refuse or delete cookies, namely by selecting the appropriate settings in the respective browser.

It is necessary to bear in mind, however, that deactivating cookies may affect, partially or completely, the browsing experience on the website.

13. Intellectual and Industrial Property

The photographs and illustrations used on the website are for guidance only.

All elements on this website, namely text, images, illustrations, graphics, files, layout, structure, among others, are protected by legal provisions relating to intellectual property and, in particular, by the scope of Copyright protection.

Said elements may not be copied for commercial use or distribution, nor may they be modified or forwarded to other websites.

Corporate names, brands, as well as any distinctive signs reproduced on the website are protected under the legal provisions applicable to industrial property. The reproduction or representation of all or part of these distinctive signs is strictly prohibited.

14. Exclusion of Warranties and Liability Related to the Site

AGROVIA does not guarantee the availability or continuity of operation of the website and services and excludes any responsibility for damages of any nature that may be due to the lack of these.

AGROVIA reserves the right to refuse or withdraw access to the website or services, at any time and without the need for prior notice, on its own initiative or that of a third party, to Customers who do not comply with these General Conditions and/or the applicable legislation.

15. Applicable Law and Competent Forum

These General Conditions of Sale are subject to the application of Portuguese Law.

Any conflict or divergence in interpretation of the General Conditions will be submitted to the Judicial Court of the District of Lisbon West – Oeiras, with express waiver of any other, except if the Customer chooses to resort to alternative dispute resolution under the terms below.
